CASE STUDY — STATUTORY DISTRIBUTION

THE SITUATION

A Bangkok family of four adult children came to us following their mother's death. No will existed. The estate included two properties and a number of bank accounts. Three of the four siblings were in agreement about the distribution; one had a different view and had consulted a separate lawyer.

WHAT WE DID

We prepared a written analysis of the statutory position, which confirmed that the statutory provisions left less room for interpretation than the dissenting sibling's lawyer had suggested. We shared this analysis with all four parties and offered to discuss it. A meeting followed, and the matter was resolved by agreement.

THE OUTCOME

Agreed distribution documented and filed within seven weeks of instruction. No formal proceedings required. The family did not need to go to court.

CASE STUDY — DOCUMENT AUTHENTICATION

THE SITUATION

A German national living in Bangkok died leaving a will executed in Germany. The will covered Thai-located assets, but the financial institution holding the assets refused to act on it without formal Thai authentication. The family had already spent three months trying to navigate the process independently.

WHAT WE DID

We reviewed the will, confirmed its formal validity under German law, and prepared the authentication application for the Thai authorities. We coordinated with the German consulate in Bangkok and the relevant Thai ministry, and accompanied the documents through the process.

THE OUTCOME

Authentication completed in six weeks. The financial institution accepted the authenticated documents and released the assets. Total time from Sila Law instruction to resolution: six weeks.

CASE STUDY — DISPUTED REPRESENTATION

THE SITUATION

A will was challenged by one of three beneficiaries, who claimed the testator lacked capacity at the time it was made. The remaining two beneficiaries retained Sila Law to represent them in the proceedings. The estate included a business and two residential properties in Bangkok.

WHAT WE DID

We reviewed the complete documentary and medical record, assessed the strength of the challenge, and advised our clients honestly on the likely range of outcomes. We prepared the case file and represented the clients through two hearings. After the second hearing, the other party's counsel raised the possibility of settlement and we discussed the options carefully with our clients.

THE OUTCOME

Settlement reached after approximately five months. Our clients received a distribution consistent with the will's principal provisions. The matter avoided a full trial.
