Terms & Conditions

These terms govern the use of the Sila Law website and set out the basis on which we engage with enquirers and clients. Please read them carefully before using this site or requesting our services.

  • "Agreement" — these Terms & Conditions as amended from time to time.
  • "We / Us / Our" — Sila Law, 234/19 Pradiphat Road, Phaya Thai, Bangkok 10400, Thailand.
  • "User / You" — any person who accesses or uses this website or submits an enquiry.
  • "Services" — the legal services described on this website, including Statutory Inheritance Distribution Counsel, Inheritance Document Authentication, and Disputed Inheritance Representation.
  • "Content" — all text, images, graphics, and other material published on this website.
  • "Engagement" — a formal agreement to provide legal services, documented in a separate engagement letter.

Acceptance of Terms

By accessing this website or submitting an enquiry, you confirm that you are at least 18 years of age, have the legal capacity to enter into binding agreements, and agree to be bound by these Terms. If you do not agree, please do not use this website.

Submission of an enquiry form does not create a solicitor-client relationship or any obligation on either party. A formal engagement is only established when a written engagement letter has been signed by both parties.

Service Description

Sila Law provides legal services in Thailand relating to inheritance matters, including statutory distribution, document authentication, and disputed inheritance representation. Our services are available to individuals and families whose matters involve Thai law, or international matters where Thai legal assistance is required.

Services are provided subject to applicable Thai law and professional rules governing legal practice in Thailand. We reserve the right to decline any matter at our discretion, including where a conflict of interest exists or where we consider the matter falls outside our areas of practice.

User Responsibilities

When using this website, you agree to:

  • Provide accurate and truthful information in all communications and enquiry forms.
  • Use the website only for lawful purposes and in a manner consistent with applicable law.
  • Not attempt to interfere with the operation of the website or access it by means other than the interface provided.
  • Not use the website to transmit harmful, defamatory, or unlawful content.
  • Not reproduce or distribute website content without prior written consent.

Where you provide information on behalf of another person, you confirm that you have their authority to do so and that the information is accurate to the best of your knowledge.

Fees & Payment

Service fees are as stated on the website at the time of enquiry and are denominated in Thai Baht (฿). All fees are subject to applicable Thai taxes. The fees published are indicative starting prices; the fee applicable to a specific matter will be confirmed in the engagement letter following a review of the circumstances.

Payment terms, accepted methods, and invoicing arrangements are confirmed in the engagement letter. We may require payment of a retainer before commencing work.

Fees paid in respect of work already performed are generally non-refundable. Where a matter does not proceed to formal engagement, any consultation fee paid will be confirmed in writing before the consultation takes place.

Service-Specific Terms

The following additional terms apply to our core service areas:

Statutory Inheritance Distribution Counsel

This service covers an analysis of applicable statutory rules and assistance with agreed distributions or formal procedural steps. It does not cover formal court proceedings, which are subject to separate terms if required.

Inheritance Document Authentication

This service covers review, coordination with relevant authorities, and preparation of authentication applications. Fees quoted do not include government filing fees or third-party charges, which are payable separately.

Disputed Inheritance Representation

This service covers formal procedural representation in inheritance disputes. We will advise at each stage on timelines, costs, and the range of possible outcomes. We cannot and do not provide assurances as to the outcome of any proceedings. Settlement opportunities will be discussed with the client as they arise.

Our liability in connection with a formal engagement is governed by the terms of the applicable engagement letter and applicable professional indemnity obligations. Nothing in these Terms limits liability that cannot be excluded by law.

Indemnification

You agree to indemnify and hold harmless Sila Law and its staff from and against any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these Terms, your use of the website in a manner not authorised by these Terms, or any information you provide that is inaccurate or misleading.

Termination

We reserve the right to restrict or terminate access to this website at any time, without notice, in the event of a breach of these Terms or for any other reason at our discretion.

Termination of website access does not affect any formal engagement in progress, which continues to be governed by the applicable engagement letter. Provisions of these Terms that are intended to survive termination (including disclaimers and limitations of liability) shall continue to apply.

Dispute Resolution

These Terms are governed by the laws of the Kingdom of Thailand. Any dispute arising from your use of this website or from these Terms shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.

General Provisions

  • Entire agreement: These Terms constitute the entire agreement between us in respect of your use of this website, superseding any prior arrangements.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
  • Waiver: Failure to enforce any provision does not constitute a waiver of the right to enforce it at a later stage.
  • Assignment: We may assign our rights and obligations under these Terms. You may not assign your rights without our written consent.
  • Notices: Formal notices to us should be sent to [email protected] or by post to our Bangkok address.

Changes to These Terms

We may revise these Terms from time to time. The revised version will be published on this page with an updated effective date. Continued use of the website after the effective date constitutes acceptance of the revised Terms. If you do not agree to a revision, please discontinue use of the website.
